Options When Facing Foreclosure
There are many people today who are facing foreclosure fora number of reasons. Some people secured a home loan that was more than they should have been able to get, and now they are paying for it. Other people have a home loan that they want to get out of since they lost their job, but the housing market won't allow for movement since home prices are down. For people in desperate situations, foreclosure on a home is becoming more and more common. There have been measures taken to help prevent home owners from losing their home, but there are still a lot of questions surrounding what should and should not be done in these scenarios. One question that many people are asking is can bankruptcy stop foreclosure? The cons in this scenario seem to outweigh the pros, especially with some of the new government plans to help home owners stay in their homes.
Some of the cons to filing for bankruptcy are associated with the mortgage company and the action that they can take. Even after filing, the mortgage company may still be able to get around the bankruptcy and continue with the collection of past due payments. An agreement with the company would still need to be secured, even after filing for bankruptcy. The problem is that you will lose the leverage you once had. If you are late on one payment, the stay on the creditors will be lifted, and you will be back where you started.
The pros the filing for bankruptcy would be that you would be able to delay the foreclosure of the home. In the case of someone who just needs a little more time, it may be a solution. If there is a job in sight, and a way to pay back the money once the bankruptcy is filed, it may be a temporary solution that will allow just a little more time to work out the way to pay off bills.
Depending on each individual case, there are many ways to be able to pay on mortgage loans. There are many solutions, especially some of the new bailout bills, refinance options, and some others. Filing for bankruptcy may work for some people, on a case by case basis.
